Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Achiever Board website and application located at https://achieverboard.com/ (the "Service"), operated by Achiever Board ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Description of Service

Achiever Board is a free, browser-based task management application that provides kanban-style boards for personal and team productivity. The Service is offered at no cost and is intended to help individuals and teams organize, track, and manage tasks online.

Achiever Board offers two modes:

• Team Board — requires creating a user account; supports multiple users, task assignments, and real-time collaboration.
• Solo Board — no account required; provides a private personal kanban board identified by a board name of your choosing.

2. Eligibility

You must be at least 13 years of age to use Achiever Board. By using the Service, you represent that you are at least 13 years old. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. User Accounts

When you create an account on the Team Board, you agree to:

• Provide accurate and complete information during registration.
• Keep your password secure and confidential.
• Be responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Acceptable Use

You agree to use Achiever Board only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use of the Service. Specifically, you agree not to:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Use the Service to send spam, unsolicited messages, or engage in any form of automated scraping.
• Upload malicious code, viruses, or any software intended to damage or interfere with the Service.
• Use the Service for any commercial purpose without our express written consent.
• Violate any applicable laws or regulations.

5. User-Generated Content

You retain ownership of any content you create using Achiever Board (tasks, descriptions, notes, attachments, etc.). By submitting content to the Service, you grant us a limited, non-exclusive license to store and display that content solely for the purpose of providing the Service to you.

You are solely responsible for the content you upload and ensure that you have the right to use and share it within the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

7. Service Availability

Achiever Board is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or always available. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

8. Intellectual Property

The Achiever Board name, logo, interface design, and underlying code are the property of Achiever Board and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Nothing in these Terms transfers any intellectual property rights to you beyond what is necessary to use the Service as intended.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE AT ANY PARTICULAR TIME, BE SECURE, OR BE FREE FROM ERRORS OR VIRUSES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TASKBOARD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED $0 (GIVEN THAT THE SERVICE IS PROVIDED FREE OF CHARGE).

11. Third-Party Services

Achiever Board integrates third-party services including Google Firebase, Google Fonts, and may display advertisements via Google AdSense. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

12. Termination

You may stop using the Service at any time. You may delete your account from within the app's Profile Settings page. Upon deletion, your account data will be permanently removed from our systems.

We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, if we believe you have violated these Terms.

13. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts in your jurisdiction.
